These Terms and Conditions ("Terms") govern Your access to and use of the websites, platforms and services operated by Pegasus Photo Creations CommV, including the booking platform, the webshop, the on-site sales kiosk, and any photo delivery system ("the Service").
By using the Service, placing an order, or making a booking, You agree to these Terms. If You do not agree, please do not use the Service.
These Terms should be read together with Our Privacy Policy, Cookie Policy, Disclaimer, and Delivery and Returns Policy.

2. Definitions
In these Terms:
- Customer means any natural or legal person placing an order or making a booking through the Service.
- Consumer means a Customer who is acting for purposes outside their trade, business, craft or profession (Article I.1, 2° Code of Economic Law).
- Business Customer means a Customer who is not a Consumer.
- Booking means a pre-event reservation of a photography package, reel or other photography service offered through the booking platform.
- Order means any purchase of Photographs (digital or printed) or other products through the webshop or kiosk.
- Photographs means any photographic, video or digital imagery created by or on behalf of Pegasus Photo Creations and made available through the Service.
- Event means a sporting event (typically equestrian) at which Pegasus Photo Creations is the official or authorised photographer.
3. Scope and Applicability
These Terms apply to every offer, Booking and Order between Pegasus Photo Creations and the Customer, to the exclusion of the Customer's general or purchase conditions, even where those state otherwise, unless expressly accepted in writing by Pegasus Photo Creations.
By placing an Order or Booking, the Customer confirms having read and accepted these Terms.
Specific terms may apply to particular Events, packages or product types; where these are clearly indicated at the point of purchase, they prevail over these Terms in case of conflict.
4. Offers and Pricing
4.1 Offers
All offers, prices and product descriptions on the Service are non-binding until an Order or Booking is confirmed by Pegasus Photo Creations. Pegasus Photo Creations reserves the right to correct manifest errors or pricing mistakes prior to confirmation, and to refuse Orders that result from such errors.
4.2 Prices
Prices are shown in euros (EUR) and:
- for Consumers: include Belgian VAT and any other applicable taxes;
- for Business Customers in another EU Member State who provide a valid VAT number verified through VIES: are shown excluding VAT, with reverse charge applied in accordance with Article 196 of the VAT Directive (2006/112/EC);
- for Business Customers outside the EU: are shown excluding VAT; the Customer is responsible for any import duties or local taxes.
Shipping costs are not included in product prices and are shown separately at checkout.
4.3 Promotions and discounts
Promotions, discount codes and bundle offers are valid only for the period and conditions specified at the time of the offer. They cannot be combined with other promotions unless expressly stated.
5. Conclusion of the Contract
The contract between Pegasus Photo Creations and the Customer is concluded when:
- for Orders: the Customer has completed checkout, payment has been authorised, and Pegasus Photo Creations has sent an order confirmation email;
- for Bookings: the Customer has completed the booking flow, payment has been authorised (or a valid Sytist credit has been applied), and Pegasus Photo Creations has sent a booking confirmation email.
Pegasus Photo Creations reserves the right to refuse any Order or Booking, in particular in case of suspected fraud, payment issues, manifest pricing errors, or unavailability.
6. Payment
6.1 Methods
Payment is processed at the time of Order or Booking through Our payment partners, currently Mollie B.V. (Netherlands) and Stripe Payments Europe Ltd. (Ireland). The available payment methods include but are not limited to credit/debit card, Bancontact, iDeal and SEPA-based methods, depending on the Customer's location.
6.2 Payment confirmation
Orders and Bookings are not confirmed until payment is authorised. Pegasus Photo Creations does not store full payment card details; this information is handled by the payment processors under their own privacy policies and PCI-DSS-compliant standards.
6.3 Late payment (Business Customers)
For Business Customers, in case of late payment of an invoice, the following automatically applies, without prior notice:
- interest at the legal rate for B2B transactions under the Belgian Act of 2 August 2002 on combating late payment in commercial transactions, and
- a flat fee of 10% of the unpaid amount, with a minimum of EUR 50, by way of compensation for collection costs.
7. Bookings (Pre-Event Photography Packages)
7.1 What a Booking covers
A Booking entitles the Customer to the photography services described in the relevant package (for example: photography of a specific rider/horse combination during a specific class on a specific Event day, with delivery of a defined number of edited Photographs and/or a reel).
7.2 Conditions of performance
Pegasus Photo Creations undertakes to perform booked services with reasonable care and skill. However, the Customer acknowledges that Event photography is dependent on factors outside Our control, including:
- the actual participation of the booked rider/horse in the booked class,
- the timing and order of classes (which may change),
- weather, lighting and arena conditions,
- technical issues with photography equipment,
- the actions of the rider, horse, organisers and other photographers.
7.3 No-show, withdrawal or elimination
If the booked rider/horse does not start, withdraws, or is eliminated before any usable Photographs can be taken, the following applies:
- where Pegasus Photo Creations has not yet performed substantial photography work, We will offer a credit valid for a future Event (Sytist credit or equivalent) or, at Our discretion, a refund;
- where Pegasus Photo Creations has performed photography work and at least some usable Photographs exist, the Booking is fulfilled and no refund is due.
7.4 Event cancellation or rescheduling
If an Event is cancelled or rescheduled by the organiser:
- where the Event is rescheduled and the Customer can attend the new date, the Booking remains valid;
- where the Customer cannot attend the new date, or where the Event is cancelled outright without rescheduling, the Customer is entitled to a Sytist credit or refund of the Booking fee, less any non-refundable third-party costs already incurred.
7.5 Reels
Where the Booking includes a video reel, the reel is delivered as a short video clip in the format and length stated at the point of purchase. Music in reels, where included, is sourced from libraries with appropriate commercial licences. The Customer is granted a personal-use licence for the reel only.
7.6 Booked-out services
Some services may be temporarily booked out during peak periods or specific Event days. Pegasus Photo Creations does not guarantee availability of any specific package and reserves the right to mark services as booked out at any time.
8. Photographs and Deliverables
8.1 Editorial discretion
Pegasus Photo Creations exercises reasonable editorial and technical discretion in selecting, editing and delivering Photographs. The Customer accepts that:
- not every moment is photographed;
- not every photograph taken is edited or made available;
- the technical and artistic quality of Photographs depends on conditions outside Our control.
8.2 Delivery
Delivery of Photographs is governed by Our Delivery and Returns Policy.
8.3 Storage and availability
Pegasus Photo Creations stores Photographs in its archive but does not guarantee that any specific Photograph will remain available for purchase indefinitely. Customers wishing to obtain Photographs of an older Event are advised to contact Us by email; reasonable efforts will be made to retrieve archived Photographs, subject to availability.
9. Intellectual Property and Licence
9.1 Ownership
All Photographs and other content created by Pegasus Photo Creations are protected by copyright and remain the exclusive property of Pegasus Photo Creations. No transfer of copyright is implied by the purchase of a Photograph.
9.2 Licence granted to the Customer
By purchasing a Photograph (digital or printed), the Customer obtains a personal, non-exclusive, non-transferable licence to use the Photograph for personal, non-commercial purposes only. This includes:
- displaying the Photograph in private settings,
- sharing the Photograph on the Customer's personal social media (with credit where reasonably possible),
- printing or having the Photograph printed for personal use.
9.3 Restrictions
Without the prior written permission of Pegasus Photo Creations, the Customer may not:
- remove, obscure or alter watermarks, signatures or copyright notices;
- resell, sublicense or redistribute Photographs in any form;
- use Photographs for commercial purposes (including advertising, sponsorship communication, brand publications, sales catalogues, stallion or breeding promotion);
- submit Photographs to competitions, magazines or media outlets without proper credit and prior consent;
- train artificial intelligence or machine-learning models on Photographs.
9.4 Commercial licences
For commercial use, including by riders, owners, breeders, sponsors and media, a separate written commercial licence is required. Please contact Us for terms and pricing.
9.5 Pegasus Photo Creations' own use
Pegasus Photo Creations may use Photographs taken at Events for its own marketing, portfolio, social media and promotional purposes, with discretion and respect for the rights of Subjects. Subjects retain the right to object as set out in the Privacy Policy.
10. Right of Withdrawal
The right of withdrawal under EU consumer law is set out in detail in Our Delivery and Returns Policy.
In summary:
- Digital downloads: the right of withdrawal is waived at checkout in accordance with Article VI.53, 13° of the Belgian Code of Economic Law.
- Made-to-order prints: the right of withdrawal does not apply under Article VI.53, 3° of the Code of Economic Law.
- Bookings: Bookings concern photography services for specific Events on specific dates. The right of withdrawal does not apply to services that have begun to be performed with the Customer's consent (Article VI.53, 12° of the Code of Economic Law); refunds and credits in case of no-show, withdrawal or Event cancellation are governed by Section 7.
These exceptions do not affect statutory consumer rights in case of non-conformity (see Section 11).
11. Conformity and Legal Warranty
For physical products delivered to Consumers, the legal warranty for non-conformity (Articles 1649bis–octies of the Belgian Civil Code, transposing EU Directive 2019/771) applies. This warranty covers a lack of conformity that exists at the time of delivery and becomes apparent within two (2) years from the date of delivery.
For digital content, the legal warranty under Articles 1701/1 et seq. of the Belgian Civil Code (transposing EU Directive 2019/770) applies for the period during which the digital content is supplied or, for one-off supplies, for two (2) years from supply.

12. Liability
12.1 General
Pegasus Photo Creations performs its services with reasonable care and skill. To the maximum extent permitted by Belgian law, Our total liability under or in connection with a Booking or Order is limited to the amount actually paid by the Customer for that specific Booking or Order.
12.2 Excluded losses
To the maximum extent permitted by law, Pegasus Photo Creations is not liable for indirect or consequential losses, loss of profit, loss of opportunity, loss of goodwill, or losses arising from circumstances outside Our control.
12.3 Mandatory liability
Nothing in these Terms limits or excludes liability for:
- death or personal injury caused by negligence;
- fraud or fraudulent misrepresentation;
- intentional misconduct or gross negligence;
- any liability that cannot lawfully be excluded under Belgian law.
13. Force Majeure
Pegasus Photo Creations is not liable for any failure or delay in performance caused by circumstances beyond Our reasonable control, including but not limited to: extreme weather, strikes, transport disruption, pandemics, government measures, technical failures of third-party platforms, payment-processor outages, and the cancellation, postponement or material modification of an Event by its organiser.
In case of force majeure affecting a Booking, Pegasus Photo Creations will, at its discretion, offer a Sytist credit for a future Event, reschedule the service, or refund the Booking fee, less any non-refundable third-party costs already incurred.
14. Personal Data
The processing of personal data in connection with the Service is described in Our Privacy Policy.
15. Communication and Notices
The Customer accepts that communication regarding Bookings and Orders is conducted primarily by email. The Customer is responsible for providing a valid email address and ensuring that messages from Pegasus Photo Creations are not blocked by spam filters.
Notices to Pegasus Photo Creations should be sent by email to contact@pegasus-photo.com or by post to the address in Section 1.
16. Complaints
Pegasus Photo Creations strives to handle complaints quickly and constructively. Please contact Us by email at contact@pegasus-photo.com (general) or webstore@pegasus-photo.com (orders and deliveries). We will acknowledge complaints within a reasonable period and aim to resolve them within 30 days.
For unresolved consumer disputes, You may use the European Commission's Online Dispute Resolution platform: https://ec.europa.eu/consumers/odr.
17. Modifications
Pegasus Photo Creations reserves the right to modify these Terms at any time. The version published on the Service is the version in force, and applies to Orders and Bookings placed after publication of the modification.
For material changes affecting existing contractual relationships, We will provide reasonable advance notice and, where appropriate, the right to terminate ongoing arrangements.
18. Severability
If any provision of these Terms is held to be invalid, illegal or unenforceable, the remaining provisions shall remain in full force and effect. The invalid provision shall be replaced by a valid provision that most closely reflects the original intent.
19. Applicable Law and Jurisdiction
These Terms and any dispute or claim arising out of or in connection with them (including non-contractual disputes or claims) shall be governed by and construed in accordance with Belgian law.
The courts of the judicial district of Brussels (Dutch-language section) shall have exclusive jurisdiction to settle any dispute, without prejudice to any mandatory provisions of consumer law granting a Consumer the right to bring proceedings before the courts of their place of residence.
